Electronic Delivery of Communications and Use of Electronic Signatures

Your agreement to this E-sign Consent confirms your ability and consent to receive “Communications” electronically from Kiavi Funding, LLC formerly known as Kiavi Funding, Inc., our subsidiaries, affiliates, and third party service providers, rather than in paper form, and to the use of electronic signatures in our relationship with you (“Consent”). If you choose not to agree to this Consent you may be restricted from using Kiavi’s website and online services. Communications, as defined here, include but is not limited to, each disclosure, notice, agreement, fee schedule, statement, record, document, and other information we provide to you, or that you sign or submit or agree to at our request.

System Requirements

To receive and view Communications electronically, you need access to a supported Internet browser (such as Microsoft Edge, Google Chrome, Mozilla Firefox, or Apple Safari) and a PDF reader such as Adobe Acrobat Reader. To retain copies of Communications for your records, your device must have an active email account, sufficient storage capacity to download electronic files, or access to a functioning printer.

Change of Designated Email Address

You must promptly notify us of any change in your email or other electronic address. You may change your email address by updating your contact information on your online dashboard or by contacting us toll-free at 844-415-4663.

Withdrawing Consent

Your withdrawal of consent will become effective after we have had a reasonable period of time to process your request. Withdrawing your consent will not affect the legal validity, enforceability, or binding nature of any electronic Communication or signature completed prior to the effective date of your withdrawal. You may withdraw your consent to receive electronic Communications at any time by emailing us at esign@kiavi.com or writing to: Kiavi, 271 N.
